Why Everyone Hates Defense Attorneys (until they need one)

We know not many people like defense attorneys. Even Atticus Finch, the hero of the classic novel To Kill a Mockingbird, was despised by most of the characters in that novel. Prosecutors (DAs) are often seen as the ‘good guys’ who wear the white hat and protect victims from bad guys. Defense attorneys are often seen as those who excuse, mitigate and defend criminals. Many people buy into this stereotype … until they are accused of something.
The Colorado criminal statutes fill a book of fine print over an inch thick. There are hundreds or thousands of offenses in this book of statutes. All that is required for police to make an arrest is one person claiming that you have violated one of those laws. That means you may or may not have done anything wrong.
Anyone can be accused and arrested.
Our clients routinely ask us how they can protect themselves from these accusations, and we have to tell them that there is no protection. Your right to defend against any accusation is enshrined in your right to a jury trial. Jury trials are sometimes an expensive, risky proposition that don’t occur until months after an accusation is made.
Police officers and prosecutors are often just officials who shepherd accusations through the system. They often rely on fear and intimidation to secure standard plea agreements. Once people realize this, they come to appreciate the value of an experienced defense attorney who can help them stand up to the machinery of the government.
Why You May Need A Defense Lawyer
You may need someone to tell your whole story and provide important context. Or maybe someone to challenge the credibility of the accuser. A defense attorney is the only person in the court system who is focused on your individual situation and obtaining a good result for you.
Despite their bad rap, defense attorneys are the ones who advocate for citizens against a government engine that is too big, too busy and too self-righteous to actually seek individual truth and justice. (To give credit where it is due, there are some really good cops and prosecutors who will listen and take action when they are presented with the right information).
Defense attorneys are the ones who know that a jury of your peers can often be persuaded to see the truth and recognize government injustice. When you need an advocate to tell your story in the face of immense pressure to just plead guilty and trust the system … you need a criminal defense attorney.
But there is one way in this country in which all men are created equal- there is one human institution that makes a pauper the equal of a Rockefeller, the stupid man the equal of an Einstein, and the ignorant man the equal of any college president. That institution gentlemen, is a court. It can be the Supreme Court of the United States or the humblest JP court in the land, or this honourable court which you serve. Our courts have their faults as does any human institution, but in this country our courts are the great levelers, and in our courts all men are created equal.
